Welcome. We know legal pages are not the most exciting read, but this one matters. These Terms set out your rights, our responsibilities, and everything in between when you use the RIVA website and shop with us.

This website is operated by RIVA, a brand of Happy Cart Limited, a business entity registered in Hong Kong.

Our Privacy Policy is a separate document, available on our website. Together with these Terms, it governs your use of our Site and any orders you place. We refer to all of this together as the "Terms".

(i) Website Terms of Use

Who we are

We're RIVA, a brand operated by Happy Cart Limited, a Hong Kong-registered business entity. We run the website rivaaustralia.com (the "Site").

When we say "we", "us" or "RIVA", we mean Happy Cart Limited trading as RIVA. When we say "you", we mean the customer, browser or visitor using our Site.

Access to the Site

By using our Site, you agree to these Terms. If you do not agree, please do not use the Site. We update these Terms and the Site from time to time, so it is worth checking back now and then. The version of the Terms in force when you place an order is the one that applies to that order.

We may suspend, restrict or remove access to the Site at any time, for example for maintenance, updates, or to address technical or legal issues.

Who can use the Site

Our Site is intended for people aged 18 or over who live in Australia. Visitors from other countries are welcome to browse, but our products are only sold and shipped to addresses in Australia, and your local laws may apply to your use of the Site.

Intellectual property

Everything on our Site, including product photos, graphics, logos, designs and text, is protected by copyright, trade marks and other intellectual property rights. It either belongs to us or we have permission to use it. You are welcome to screenshot or share content for personal, non-commercial use, but please do not use anything for commercial purposes without our written permission.

If we enable social sharing features, feel free to use them, and please credit us where appropriate.

Information on the Site

We work to keep our Site accurate and current, but we cannot guarantee that every detail is correct, complete or up to date at all times. Product descriptions, images, colours and availability can change. If something is genuinely important to your decision to buy, contact us first.

Security and links

We take security seriously, but we cannot promise the Site will always be free of bugs, viruses or interruptions. We recommend running your own antivirus protection and browsing responsibly.

Our Site sometimes links to third-party websites for further information. We are not responsible for the content of those sites or how they handle your data.

Cookies

We use cookies. These small data files help us improve your experience and understand how people use our Site. You can block them in your browser settings, but doing so can affect how the Site works. For details, see our Privacy Policy.

(ii) Terms of Sale

Ordering from RIVA

When you place an order through our Site, you agree to these Terms of Sale. You must be 18 or over and have a delivery address in Australia to place an order.

Placing an order is an offer to buy the product. We send you an order confirmation email, but a contract between us is only formed when we dispatch your order. We reserve the right to decline or cancel orders, for example if a product is out of stock, if there is an error in the price or description, or if we suspect fraud.

Prices and currency

Prices on our Site are displayed in Australian Dollars (AUD) and all transactions are processed in AUD.

Displayed prices include applicable GST, which we collect and remit under the simplified GST regime for non-resident suppliers in Australia. Because we operate under this simplified regime, we do not hold an Australian Business Number (ABN) and are therefore unable to issue tax invoices. An order receipt is provided by email for your records.

As RIVA is operated by Happy Cart Limited, a Hong Kong-registered entity, your bank or card issuer may treat your payment as an international transaction and apply an international transaction fee. These fees are set by your bank and are outside our control. The final amount on your statement may therefore differ slightly from the price shown at checkout. If you want to confirm any fees before ordering, we recommend checking with your card provider.

Payment

We accept major credit and debit cards, PayPal and Apple Pay. All payments are processed securely by our payment providers. We never store your full card details. If a payment is declined or reversed, we may cancel your order.

Filter Club subscriptions

If you join Filter Club, our refill subscription, you will be billed $44.95 AUD every 3 months for a RIVA Refill Core box, with your first box free. Each renewal is charged to the payment method on file, and we send you a reminder before each billing date. You can skip a delivery, pause your subscription, or cancel it at any time through the link in any Filter Club email or by contacting info@rivaaustralia.com. Cancellations take effect before your next billing date, provided you contact us before that date. There is no lock-in period and no cancellation fee.

Shipping and delivery

We aim to dispatch orders within 1 to 2 business days. Estimated delivery time for Australia is approximately 5 to 10 business days.

You receive a tracking link once your parcel leaves our warehouse. Delivery times are estimates, not guarantees. Actual times can vary due to courier delays, customs processing where applicable, or events outside our control.

You are responsible for entering the correct shipping address. If you enter an incorrect address or miss your delivery, you may need to cover the cost of redelivery or reshipping.

Returns and money-back guarantee

Not in love with your RIVA ONE? No stress. You can return unused items in their original condition within 60 days of your order date. You cover return postage unless the item is faulty or not as described. To start a return, email info@rivaaustralia.com and we will guide you through the process and provide the returns address in our reply.

Refunds are issued to your original payment method within a reasonable time after we receive your return.

Faulty or incorrect items

If your item arrives damaged, faulty or not as described, email info@rivaaustralia.com with a photo as soon as possible. Depending on the situation and your legal rights, we will offer a refund, replacement or exchange.

Your consumer rights are protected

Nothing in these Terms removes or limits any rights you have under the consumer protection laws that apply where you live, including the Australian Consumer Law for Australian customers.

These laws provide guarantees about the quality, fitness and description of goods, and our Terms should be read alongside them. If anything in our Terms conflicts with those rights, your statutory rights apply.

Promotions and discounts

Promo codes must be entered at checkout and cannot be added afterwards. Only one code can be used per order unless we state otherwise. Some offers have time limits, minimum spend requirements, or apply only to specific products. Check the details before applying a code.

Product availability

Sometimes stock sells out faster than expected. If something you ordered is unavailable, we will let you know and either refund you or suggest a similar option.

(iii) General Legal Terms

Limitation of liability

We work hard to make your shopping experience smooth, but to the extent permitted by law, we are not liable for things outside our reasonable control, such as delivery delays, website outages, or supply issues.

We are also not liable for indirect, incidental or consequential loss or damage. However, nothing in these Terms excludes, restricts or modifies any consumer rights or guarantees that cannot legally be excluded, including rights under the Australian Consumer Law.

Severability

If any part of these Terms is found to be invalid, illegal or unenforceable, the rest of the Terms continue to apply.

Changes to the Terms

We may update these Terms from time to time. If we make significant changes, we will let you know, for example by posting a notice on our Site. The version of the Terms in force when you place an order applies to that order.

Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction to hear any disputes.

However, if you are a consumer, you may also be entitled to bring proceedings in the courts of the place where you live, and you keep the benefit of the mandatory consumer protection laws that apply there. Nothing in this section affects your right as a consumer to rely on those mandatory protections.
